Married with Children

This is what happens if you are a married person with children and die intestate in Scotland.

The surviving spouse receives the same as 'married, no kids' but the figure of £58,000 is reduced to £35,000, plus one third of your moveable estate.

The remainder passes to the children.

Where the children are under 16 years a guardian needs to be appointed in case they are orphaned - otherwise your child may become involved in custodial battles and placed into care.
